To the fullest extent permitted by law, Xtatic LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of or inability to access or use the platform
• Any conduct or content of any third party on the platform
• Unauthorized access, use, or alteration of your transmissions or content

Xtatic reserves the right to suspend or terminate your access to the platform at any time, with or without cause, and with or without notice, for conduct that Xtatic believes:

• Violates these Terms of Service
• Is harmful to other users, Xtatic, or third parties
• Violates applicable law or regulation

8. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Georgia and the United States of America, without regard to its conflict of law provisions. Any legal action or proceeding arising under these terms shall be brought exclusively in the courts located in Georgia.
